It's not necessary to be a lawyer in order to apply for a trademark. Anyone can submit a trademark application to the U.S. Patent and Trademark Office (USPTO). However, registering a trademark involves more than just filling out a form. It's essential to conduct thorough research, accurately identify and clearly explain your trademark to ensure it receives adequate protection. And even after securing a trademark, you've got to monitor it consistently to make sure it's free from infringement.
The big takeaway here is that it's always a good idea to work with a trademark attorney to protect the intellectual property that you've worked so hard to establish. According to the Wall Street Journal, applicants are approximately 50% more likely to secure their trademark than people who file applications on their own. If your trademark application is rejected by the USPTO, you will need to revise and refile it, incurring additional filing fees. To avoid delays and extra costs, it is best to have a trademark lawyer help you get it right the first time.
Great trademark attorneys (like those you'll find at Sausser Summers, PC) will help with every step of filing and enforcing your trademark. Some additional benefits include the following:
Check to see if your proposed trademark is registered by another entity.
Conduct research to see if another business is using the trademark for which you're applying.
Provide advice and guidance on the strength of your trademark.
Draft and submit your trademark applications and application revisions.
Advice and guidance regarding trademark maintenance and protection.
Monitor the market for unauthorized use of your trademark.
Trademark enforcement to protect you against infringement.

Online services, can provide you with basic assistance in filing your trademark. However, they will never be a legitimate substitute for an experienced trademark attorney helping clients in Leicester, Leicester.
Although online filing services offer a step-by-step process, they take a one-size-fits-all approach to preparing legal documents. Even their advanced service only provides basic attorney assistance in completing your paperwork and helping with minor roadblocks. Online filing services' disclaimer highlights the many limitations of its services, including the fact that communications are not protected by attorney-client privilege. In addition, online filing services cannot provide advice, explanations, opinions, recommendations, or any kind of legal guidance on possible legal rights, remedies, defenses, options, selection of forms or strategies.
In other words, online filing services can offer you the necessary forms and point you in the right direction, but they cannot customize their services to your specific needs or help you with serious complications that may arise.
For the most comprehensive trademark service and protection, it's always wise to work with highly rated trademark lawyers, like you'll find at Sausser Summers, PC.
Trademarks in the U.S. can last indefinitely, but did you know that clients in Leicester, Leicester can file a trademark online, only to lose protection in some circumstances? Trademarks differ from patents and copyrights in that they do not have an expiration date. However, to prevent the cancellation of a trademark, you must maintain it. To ensure that your trademark remains protected, you must actively use it in commerce and renew it with the USPTO every ten years.
The Lanham Act tells us that "use in commerce" is the legitimate use of a trademark in the ordinary course of trade. In other words, you cannot register a trademark solely to reserve the rights to it in the future. In most cases, a trademark must be used continuously in connection with the goods or services it is registered for.
Trademarks are registered with the USPTO and generally need to be renewed every ten years. However, there is one crucial exception that you should be aware of. Within the first ten years of owning a trademark, you must file for renewal between the fifth and sixth year from the date of your initial registration.
During this renewal period, you are required to submit a Section 8 declaration, a specimen that shows how the mark is being used, and pay the required fee. You can also apply for Section 15 Incontestability status, which can strengthen your trademark rights. This application, although not mandatory, can make it harder for others to challenge your ownership of the mark.
After the first renewal, which falls between the fifth and sixth year of ownership, the next renewal filing is due between the ninth and tenth year, and then every tenth year thereafter. In the ninth year you will need to file a Section 8 declaration, attesting to your use of the mark or excusable nonuse. You've also got to file a Section 9 renewal application before the end of the tenth year to keep your registration active.
It is worth noting that the USPTO provides a six-month grace period if you fail to renew your mark within the required time frame, but it is best not to rely on it. If you don't file within the grace period time limits, the USPTO will cancel and expire your mark.
By hiring trademark attorneys helping clients in Leicester, Leicester, you can avoid the pitfalls and mistakes that can arise and cause you to lose your rights to the mark that represents it.
In the event that you stop using your trademark and have no plans to resume using it in commerce, it may be considered abandoned by the USPTO. This could result in the loss of your protective rights to the mark. Typically, a trademark is assumed to be abandoned if it has not been used for three years. However, you may be able to refute this presumption by providing evidence that you intend to use the mark again in the future.
In addition to trademark abandonment, you should also be wary of improper licensing. It's important to remember that once you allow someone else to use your trademark, you must keep an eye on how they use it. You should monitor the products or services that feature your trademark to ensure that they meet consumers' expectations in terms of quality. Failure to do so can lead to a "naked" trademark license and the loss of your protective trademark rights.
If you're wondering how you can avoid refiling your trademark, the answer is simple: file it correctly the first time around. Filing a trademark isn't inherently difficult, but when doing so, it's very important that certain aspects are filled out accurately in your application. If any information is missing or incorrect, the trademark application may be considered "void ab initio" or void from the beginning, requiring you to file again.
To avoid this, make sure that the information you provide in the application is accurate and complete, including the ownership of the trademark. For instance, if a corporation has multiple shareholders, it should not file under the President's personal name. The rightful owner should be the one/entity that ultimately controls the trademark and the associated goods/services.
It is also important to ensure that the goods and/or services description is precise. For example, if you sell electronic products, you should not file for research and development services despite having a research and development department. The goods/services description should reflect the goods/services you offer to customers, not the departments within your business.
Additionally, providing accurate dates of first use when filing for a trademark is crucial. The USPTO requires two dates to be specified - the date of first use anywhere and the date of first use in interstate commerce. Contact our trademark law office today to learn more about having accurate dates on your filing paperwork.
At Sausser Summers, PC, we often get questions about how to distinguish run-of-the-mill consultants and others from great trademark attorneys. After all - when you're looking for an attorney to file or prosecute your business trademark, you should know their qualifications. Here are three ways you can separate the proverbial wheat from the chaff when it comes to trademark attorneys.
It's crucial to seek legal advice from a licensed trademark lawyer rather than relying on advice from non-professionals like trademark consultants. The USPTO even recommends hiring an attorney to help with the trademark process. Although trademark consultants may provide advice on trademark availability or name marketability, they cannot file the trademark for you or offer legal advice. According to the Rules of Practicing in trademark cases, "Individuals who are not attorneys are not recognized to practice before the Office in trademark matters." This rule applies to individuals who assist trademark applicants.
When searching for a trademark attorney, it's important to find someone with a strong background in trademark law. Look for an attorney who specializes in this area and has significant experience handling trademark-related cases. Avoid lawyers who don't have expertise in this field, as they may not be able to provide the guidance and support you need.
Ensure your attorney provides updates throughout the trademark registration process to avoid missing deadlines, including responding to any Office actions within six months. Failure to do so can result in trademark abandonment. The USPTO will only correspond with the listed attorney of record, so make sure your attorney keeps you informed.
In summary:
Building your brand and gaining recognition for it is a significant achievement, and it's important to protect it. However, there are certain pitfalls and mistakes that can arise, causing you to lose your rights to the mark that represents it. By working with knowledgeable trademark attorneys, you can avoid these issues and file your trademark successfully.

James Justin and Caleb Okoli were not dropped but merely given the chance for a “deep breath” when they were left out of the Leicester City starting line-up at Ipswich.
Justin had started every Premier League match up to the draw at Portman Road, while Okoli had been in the team every week since first winning his spot in August. But on Saturday afternoon, manager Steve Cooper named both on the bench, bringing Jannik Vestergaard and Victor Kristiansen into the 11.
This season, Justin has been the subject of criticism from supporters with City conceding a larger number of goals from his position at right-back. Meanwhile, Okoli had a poor game at Manchester United in midweek, gifting the Red Devils’ their fifth goal with a undercooked backpass to Danny Ward.
With Vestergaard fit again after a series of ankle injuries and Kristiansen available following a brief period out with a groin issue, Cooper was given the chance to make changes, and he took them, referencing Vestergaard’s experience. However, the manager does not want it to be framed as Justin and Okoli being dropped.
“The two that came out, Caleb’s new to the club and JJ’s been here a while,” Cooper said. “They’ve played most of the games and played the other night.
“We’ve got the opportunity to make those changes now. Sometimes leaving a player out is not them being dropped, it’s about them taking a deep breath and getting them ready to come back in.
“Victor was that, but it was forced through injury. Jannik is different. He’s been out for a while and we felt like we needed his experience in the back-line and obviously his quality as well. It’s just changes that we felt were right. We have those options. You saw the guys who came on as well. We need that.”
Both Vestergaard and Kristiansen did a decent job at Ipswich and will fancy their chances of keeping their places this weekend at Manchester United. Cooper now has a choice over whether he sticks with the Danes, or brings Justin and Okoli back in.
Justin could come in for Ricardo Pereira and return at right-back. Again, against Ipswich, the goal City conceded saw their right side exploited, albeit it was a very well-worked goal by the hosts. A clipped ball just dropped over Ricardo’s head and Abdul Fatawu had not quite tracked left-back Leif Davis, who produced a stunning volley to give the home side the lead.
When speaking about problems on the right last week, Cooper said it was not an individual problem, but a collective issue. However, he did not feel like it was a topic of conversation that would last, with other positives and negatives to take focus in the coming weeks.
He said: “If we’re talking about the right-hand side and conceding goals, I don’t think we should just talk about JJ. Obviously, he’s involved. But it’s not like he’s the only one who defends that side of the pitch. There’s centre-backs that play on that side, midfielders that play on that side, and even attacking players in front.
“We have got to try to cover the work, with and without the ball, for every position and every area of the pitch. That’s the challenge and job if you like. It’s a team thing.
“I’m sure next week there’ll be different topics that are positive and negative. We’ve just got to keep working collectively, keep believing in what we’re doing, and growing the way we want to grow.”

Leicester's Late Show Earns Ipswich Draw
‘Mixed Feelings’ For Cooper Following Ipswich Draw
- Leicester City came from behind to secure a 1-1 draw at Ipswich Town on Saturday - Jordan Ayew managed to score in injury-time after Leif Davis’ opener- The forward felt that a draw was a fair result - It was a second successive away goal from Ayew after netting at Southampton
The Ghanian came off the bench to net a stoppage-time equaliser and rescue a late point in Suffolk for the Foxes, who were behind early in the second half courtesy of Leif Davis’ stunning strike.
A potentially significant result away from home, especially following defeats to Nottingham Forest and then Manchester United in the Carabao Cup, it moves Leicester onto 10 points from their opening 10 Premier League games.
“It was a crazy moment and important to go away with something,” the forward stated following full-time. “It was a very difficult game, but I think it was an even game. Ipswich did really well, we did well as well, but sometimes you need a bit of luck and we got that bit of luck at the end of the game.

Jordan Ayew's late equaliser to rescue Leicester City a point against Ipswich Town.
“It’s massive. Especially when you've lost two games, to get something out of this game was positive. Obviously, we wanted to win the game, but when you can't win, we say you don't lose and on to the next one.
“The point is a positive thing because we fought back and it's important to have that type of spirit in the Premier League, because the Premier League is not easy, it's a difficult league. It's very difficult and ruthless as well, so we're happy with that point, I think it is a fair result.”
Having seen a previous effort saved, Ayew remained calm under pressure once more showing composure to collect Boubakary Soumaré’s pass and then exchange a quick one-two with Jamie Vardy before finishing past Arijanet Muric.
“That's why you do finishing in training,” he explained. “To know how to handle this type of situation and I'm happy because it went in, I had the first one and it was cleared off the line and the second one went in. I'm really, really pleased and it's good for confidence.
“It's good for us as a squad as well for confidence and we keep on fighting. We knew that this season would not be easy, we will have some ups and downs and it's part of the journey, so on to the next one.

Goalscorer Jordan Ayew's take on the 1-1 draw with Ipswich Town, secured in dramatic fashion during stoppage-time.
“I guess in those eight minutes of added on time. I thought we would get another chance; it fell on me and I'm pleased to have taken it. I'm always a positive person, I'm always positive in my mind, I believe so much in myself and I believe so much in the team as well.”
The Blue Army have certainly taken to the 33-year-old since his summer arrival, with Ayew’s chant again being sung loud and proud in the away end at Portman Road following his introduction and subsequent impact on proceedings.
He added on the fans' support: “It gives me a bit more desire, more energy to work harder, to do well for the team, for the Club, for the fans as well, because the Club have been good to me. They brought me in, and they've been really good to me since I've been in.
“The only thing I can do is to repay it on the pitch, and that's what I try to do. And obviously, the fans and the players have welcomed me so well and the only thing you can do is just to perform on the pitch when you have the opportunity.”

Leicester City are close to having a fully-fit first-team squad with Patson Daka and Hamza Choudhury back in training.
The duo worked alongside their team-mates at Seagrave in the build-up to the 1-1 draw with Ipswich, though neither were included in the squad. Choudhury is back after a few weeks out with a dislocated shoulder, while Daka has returned after close to three months out following ankle surgery.
The Zambian striker suffered his injury in the final pre-season game, and so has not yet played a competitive game under Steve Cooper. He will likely need a period of time to get totally up to speed but will then give the manager another alternative to Jamie Vardy up front, with Jordan Ayew and Odsonne Edouard also in competition.
Young midfielder Michael Golding, who is yet to make his City debut, is also back in training after a brief period out with injury. That means just goalkeeper Jakub Stolarczyk is out of the picture at the moment, the Pole breaking his foot in pre-season.
If Choudhury and Daka are available for selection against Manchester United this weekend, then Cooper will have 28 players to choose from, meaning eight will have to miss out on the matchday squad. Against Ipswich, changes were made to the 20-man group, with Jannik Vestergaard and Kasey McAteer returning to the fold.
That saw Bobby De Cordova-Reid and Odsonne Edouard unable to even take a place on the bench. Daniel Iversen, Luke Thomas and Will Alves were also left out.
City players potentially available for Man United: Mads Hermansen, Danny Ward, Daniel Iversen, Ricardo Pereira, James Justin, Caleb Okoli, Conor Coady, Jannik Vestergaard, Wout Faes, Luke Thomas, Victor Kristiansen, Harry Winks, Oliver Skipp, Hamza Choudhury, Wilfred Ndidi, Boubakary Soumare, Abdul Fatawu, Kasey McAteer, Bobby De Cordova-Reid, Stephy Mavididi, Jordan Ayew, Facundo Buonanotte, Will Alves, Bilal El Khannouss, Michael Golding, Jamie Vardy, Odsonne Edouard, Patson Daka.

A key Leicester City attacking duo find themselves at risk of suspension in the Premier League. So, they will need to play it safe against Man United.
At the weekend, Leicester City will face Man United. It is their second time playing Man United within the space of a few weeks. Steve Cooper will hope for a better showing than the EFL Cup Round of 16.
Without a doubt, Leicester will field their strongest possible lineup for the Premier League clash. After all, their focus will be on making progress in their bid to avoid relegation this season.
At the start of this season, certain players have proven key to this objective. While they might not be who Leicester fans would have expected, it is pivotal that Cooper maintains a strong squad ahead of the busy schedule.
Heading into the Man United vs Leicester City match, there are two standout Leicester players who are at risk of suspension. Both Jordan Ayew and Facuno Buonanotte have picked up four yellow cards this season.
Therefore, if either player is booked against Man United, they will face a one-match suspension due to Premier League rules. Given the stakes which playing at Old Trafford brings, this is not welcomed news for Leicester fans.
Without a doubt, playing against Man United will be a cagey affair for The Foxes. Both sides are eager to win, to move closer to their objectives. While a draw would suit Leicester more than Man United, it is difficult to envision either team aiming for shared points.
Leicester need to be ruthless. They must fight for every loose ball at Old Trafford, something they failed to do in the EFL Cup fixture. Therefore, this could hinder Ayew and Buonanotte, who must be more careful than others.
This season, Leicester fans are at risk of falling in love with Facundo Buonanotte. This will break rule number one of signing players on loan. It is impossible for Steve Cooper to drop him to the bench given his multidimensional talents, so he will start against Man United this weekend.
Similarly, Jordan Ayew is becoming quite a great asset for Leicester. The summer signing has surprised many, with his many clutch moments and picking up points for Leicester which wouldn't have been obtained elsewhere. So, he could play a part at Old Trafford.
