If you're an entrepreneur, you know that protecting your intellectual property should be high on your list when it comes to safeguarding your company. However, as a successful business owner, you also know the steps and costs of filing a trademark in the U.S. can be expensive and arduous.

This conundrum can be even more overwhelming for new business owners who want to do everything possible to minimize the price of securing trademarks. They try to handle complicated tasks like trademark registration on their own, which can be a big mistake - especially when juggling the day-to-day tasks of running a business. You may be thinking, "But what about those set-it-and-forget-it services you can find online? All you have to do is plug in your info, and you're done." Using pre-made templates for trademark filing can be tempting, but doing so can leave you with inadequate protection and hurt you in the long run.

So, what is the easiest, most cost-effective route to consider that also minimizes legal risk? The truth is, before you spend money on an online filing service, it's best to consult with a trademark attorney working with clients in Leicester, Leicester.

Do I Really Need a Trademark Attorney for Protecting My Business in Leicester, Leicester?

It's not necessary to be a lawyer in order to apply for a trademark. Anyone can submit a trademark application to the U.S. Patent and Trademark Office (USPTO). However, registering a trademark involves more than just filling out a form. It's essential to conduct thorough research, accurately identify and clearly explain your trademark to ensure it receives adequate protection. And even after securing a trademark, you've got to monitor it consistently to make sure it's free from infringement.

The big takeaway here is that it's always a good idea to work with a trademark attorney to protect the intellectual property that you've worked so hard to establish. According to the Wall Street Journal, applicants are approximately 50% more likely to secure their trademark than people who file applications on their own. If your trademark application is rejected by the USPTO, you will need to revise and refile it, incurring additional filing fees. To avoid delays and extra costs, it is best to have a trademark lawyer help you get it right the first time.

Additional Benefits of Using a Trademark Attorney

Great trademark attorneys (like those you'll find at Sausser Summers, PC) will help with every step of filing and enforcing your trademark. Some additional benefits include the following:

 Trademark Attorney Leicester, Leicester

Although online filing services offer a step-by-step process, they take a one-size-fits-all approach to preparing legal documents. Even their advanced service only provides basic attorney assistance in completing your paperwork and helping with minor roadblocks. Online filing services' disclaimer highlights the many limitations of its services, including the fact that communications are not protected by attorney-client privilege. In addition, online filing services cannot provide advice, explanations, opinions, recommendations, or any kind of legal guidance on possible legal rights, remedies, defenses, options, selection of forms or strategies.

In other words, online filing services can offer you the necessary forms and point you in the right direction, but they cannot customize their services to your specific needs or help you with serious complications that may arise.

For the most comprehensive trademark service and protection, it's always wise to work with highly rated trademark lawyers, like you'll find at Sausser Summers, PC.

Understanding Trademarks Over Time

Trademarks in the U.S. can last indefinitely, but did you know that clients in Leicester, Leicester can file a trademark online, only to lose protection in some circumstances? Trademarks differ from patents and copyrights in that they do not have an expiration date. However, to prevent the cancellation of a trademark, you must maintain it. To ensure that your trademark remains protected, you must actively use it in commerce and renew it with the USPTO every ten years.

The Lanham Act tells us that "use in commerce" is the legitimate use of a trademark in the ordinary course of trade. In other words, you cannot register a trademark solely to reserve the rights to it in the future. In most cases, a trademark must be used continuously in connection with the goods or services it is registered for.

Steps to Renew Your Trademark

Trademarks are registered with the USPTO and generally need to be renewed every ten years. However, there is one crucial exception that you should be aware of. Within the first ten years of owning a trademark, you must file for renewal between the fifth and sixth year from the date of your initial registration.

During this renewal period, you are required to submit a Section 8 declaration, a specimen that shows how the mark is being used, and pay the required fee. You can also apply for Section 15 Incontestability status, which can strengthen your trademark rights. This application, although not mandatory, can make it harder for others to challenge your ownership of the mark.

After the first renewal, which falls between the fifth and sixth year of ownership, the next renewal filing is due between the ninth and tenth year, and then every tenth year thereafter. In the ninth year you will need to file a Section 8 declaration, attesting to your use of the mark or excusable nonuse. You've also got to file a Section 9 renewal application before the end of the tenth year to keep your registration active.

It is worth noting that the USPTO provides a six-month grace period if you fail to renew your mark within the required time frame, but it is best not to rely on it. If you don't file within the grace period time limits, the USPTO will cancel and expire your mark.

By hiring trademark attorneys helping clients in Leicester, Leicester, you can avoid the pitfalls and mistakes that can arise and cause you to lose your rights to the mark that represents it.

Losing Your Trademark Rights Through Abandonment

In the event that you stop using your trademark and have no plans to resume using it in commerce, it may be considered abandoned by the USPTO. This could result in the loss of your protective rights to the mark. Typically, a trademark is assumed to be abandoned if it has not been used for three years. However, you may be able to refute this presumption by providing evidence that you intend to use the mark again in the future.

Losing Your Trademark Rights Through Inappropriate Licensing

In addition to trademark abandonment, you should also be wary of improper licensing. It's important to remember that once you allow someone else to use your trademark, you must keep an eye on how they use it. You should monitor the products or services that feature your trademark to ensure that they meet consumers' expectations in terms of quality. Failure to do so can lead to a "naked" trademark license and the loss of your protective trademark rights.

How to Avoid Having to Refile Your Trademark

If you're wondering how you can avoid refiling your trademark, the answer is simple: file it correctly the first time around. Filing a trademark isn't inherently difficult, but when doing so, it's very important that certain aspects are filled out accurately in your application. If any information is missing or incorrect, the trademark application may be considered "void ab initio" or void from the beginning, requiring you to file again.

To avoid this, make sure that the information you provide in the application is accurate and complete, including the ownership of the trademark. For instance, if a corporation has multiple shareholders, it should not file under the President's personal name. The rightful owner should be the one/entity that ultimately controls the trademark and the associated goods/services.

It is also important to ensure that the goods and/or services description is precise. For example, if you sell electronic products, you should not file for research and development services despite having a research and development department. The goods/services description should reflect the goods/services you offer to customers, not the departments within your business.

Additionally, providing accurate dates of first use when filing for a trademark is crucial. The USPTO requires two dates to be specified - the date of first use anywhere and the date of first use in interstate commerce. Contact our trademark law office today to learn more about having accurate dates on your filing paperwork.

What Makes an Online Trademark Attorney Great?

At Sausser Summers, PC, we often get questions about how to distinguish run-of-the-mill consultants and others from great trademark attorneys. After all - when you're looking for an attorney to file or prosecute your business trademark, you should know their qualifications. Here are three ways you can separate the proverbial wheat from the chaff when it comes to trademark attorneys.

It's crucial to seek legal advice from a licensed trademark lawyer rather than relying on advice from non-professionals like trademark consultants. The USPTO even recommends hiring an attorney to help with the trademark process. Although trademark consultants may provide advice on trademark availability or name marketability, they cannot file the trademark for you or offer legal advice. According to the Rules of Practicing in trademark cases, "Individuals who are not attorneys are not recognized to practice before the Office in trademark matters." This rule applies to individuals who assist trademark applicants.

When searching for a trademark attorney, it's important to find someone with a strong background in trademark law. Look for an attorney who specializes in this area and has significant experience handling trademark-related cases. Avoid lawyers who don't have expertise in this field, as they may not be able to provide the guidance and support you need.

Ensure your attorney provides updates throughout the trademark registration process to avoid missing deadlines, including responding to any Office actions within six months. Failure to do so can result in trademark abandonment. The USPTO will only correspond with the listed attorney of record, so make sure your attorney keeps you informed.

In summary:

  • Be sure you're using a licensed trademark attorney helping clients in Leicester, Leicester.
  • It's best to work with a trademark lawyer who has years of experience filing trademarks.
  • Ensure that your trademark lawyer is willing to provide ongoing notifications relating to your trademark application process.

Max Dowman scored a hat-trick as our under-18s made it four wins in a row with a 5-3 victory away to Leicester City on Saturday afternoon.

Alex Marciniak opened the scoring for Adam Birchall’s side, but it was Dowman who swung the tide of the game, netting two excellent solo goals and a penalty having set up Marciniak's opener.

Leicester piled the pressure on in the final 15 minutes, but a late goal from Brando Bailey-Joseph settled any nerves.

Much like our victory over Leicester a few weeks ago, the game started brightly, with Luqman Aideed and Alex Marciniak coming close for their respective sides.

We made the breakthrough in the 17th minute when Max Dowman played a smart pass to pick out Marciniak who converted from close range.

Our lead didn’t last long however, as Josh King rose highest to head home from a corner just five minutes after we’d opened the scoring.

But before the game could settle down again, Dowman took matters into his own hands, driving to the edge of the penalty area and placing a precise finish into the corner.

The tempo dropped for the remainder of the first half, allowing us to take the lead into half-time.

Ten minutes after the break Dowman topped his first half goal with an even better individual goal, running from the halfway line before slotting the ball into the corner.

The Foxes got themselves back in the game just seven minutes later through Lorenzo Strachan, but less than a minute after the restart, Dowman completed his hat-trick from the penalty spot.

We were pegged back once again with 15 minutes to go when Louis Page curled an effort in from distance, but the pressure eased after a late red card for Leicester’s Will Daniels.

Brando Bailey-Joseph scored our fifth from close range in stoppage time to wrap up another high-scoring victory for our young Gunners.

Victory in the East Midlands moves us up to fifth in the U18 Premier League South, level on points with Aston Villa in fourth.

Our under-18s take on Norwich City at Sobha Realty Training Centre next Saturday, April 12.

Kick-off in North London is scheduled for 12pm (UK time).

Leicester XI: McNab, Adedeji, Diallo, Daniels, Khela, Strachan (Owusu, 71’), Page, Aideed (Omobolaji, 79’), Akolbire (Motsi, 80’), Hutchinson, King

Gameweek 31 of the 2024-25 Premier League season concludes with a mismatch on paper, as relegation-threatened Leicester City host EFL Cup winners Newcastle United at the King Power on Monday night.

The Foxes could become the first team in English football history to lose eight successive top-flight home games without scoring this week, and they will remain deep in the Premier League's relegation zone no matter what transpires.

Sticking with the theme of eights, Newcastle are conversely hoping to pick up their eighth Premier League away win of the 2024-25 season, one that will keep their top-four destiny in their own hands.

Here, Sports Mole takes an in-depth look at the head-to-head record and previous meetings between the two sides.

Head-to-head record

Previous meetings: 135Leicester wins: 49Draws: 28Newcastle wins: 58

Over 130 years on from their maiden meeting - an 1894 Division Two showdown that Newcastle United won 2-0 - the Magpies have now battled Leicester City on 135 occasions across all competitions.

The Tyneside titans can proudly boast more victories than their Leicestershire foes, albeit not by much, as Newcastle have won 58 of the 135 head-to-heads compared to a respectable 49 for the 2015-16 Premier League champions.

Another 28 meetings between the two clubs have ended with a split of the spoils, including a goalless Premier League draw in May 2023, although Newcastle regained their ruthless rhythm in a 4-0 St James' Park pummelling in December 2024.

Thanks to that formidable home success, the Magpies are now unbeaten in each of their last five showdowns with Leicester across all tournaments; their last defeat was coincidentally also by four goals to nil at the King Power in December 2021.

In that same year, Leicester also marched to their most recent victory at St James' Park, edging out Steve Bruce's Newcastle 2-1 in January 2021 as James Maddison and Youri Tielemans netted before an Andy Carroll consolation.

However, the Foxes have since failed to score in each of their last four matches with Newcastle across the Premier League and EFL Cup; Leicester last found the back of the net in this fixture in April 2022, as Ademola Lookman opened the scoring before a Bruno Guimaraes double.

Newcastle also boast the highest margin of victory in this particular fixture, thrashing Leicester 7-1 in a First Division game in May 1993, where Andy Cole scored a hat-trick and Lee Clark chipped in with a hat-trick of assists.

Newcastle United head coach Eddie Howe is sweating over the availability of several fitness doubts for Monday's Premier League clash with Leicester City at the King Power Stadium.

All of Anthony Gordon, Joelinton, Kieran Trippier, Alexander Isak and Matt Targett are on the touch-and-go list at present, but the former appears to be the biggest worry, having been unable to train pain-free recently.

As a result, Howe should side with Harvey Barnes to operate on the left-hand side, as the former Leicester winger aims to show his erstwhile employers what they are missing out on.

The possible absence of Isak will be good news for Callum Wilson, who might make just his second Premier League start of the campaign, while Jacob Murphy operates off the right as ever.

Howe did admit to reporters that Joelinton would likely try to force himself to play through the pain, but he has no need to risk the Brazilian, as Joe Willock is more than capable of deputising alongside Sandro Tonali and Bruno Guimaraes in midfield.

Emil Krafth could also step into the backline for a rare start if need be, deputising for Trippier alongside Dan Burn, Fabian Schar, Tino Livramento and number one goalkeeper Nick Pope.

As well as the quintet of doubts, Jamaal Lascelles (knee), Lewis Hall (foot) and Sven Botman (knee) are guaranteed to miss Monday's game.

Paul Merson has made his prediction for Newcastle United’s visit to Leicester City on Monday night.

The Magpies are looking for a fourth straight win in all competitions after their 2-1 win against Brentford at St James’ Park on Wednesday night.

Alexander Isak made history for Newcastle United with his goal, while the game will always be remembered for Sandro Tonali’s wonder goal, which he admits was not deliberate.

The win saw Newcastle stay sixth in the Premier League table, but still firmly in with a chance of securing Champions League football thanks to their game in hand over Chelsea and Manchester City.

Newcastle have several injury worries, including for Isak and Anthony Gordon, who is now able to play again following the three-match ban he picked up during an FA Cup game in March.

Eddie Howe said Gordon is struggling with a hip problem, meaning he may be forced to sit out Monday’s game.

With both teams still fighting for something, Paul Merson has predicted the score for an important game at both ends of the Premier League table.

Paul Merson’s Leicester City vs Newcastle United prediction

For Leicester, it is a completely different story from Howe’s side. The Foxes are on a shocking seven-game losing streak and are spiralling towards relegation to the Championship in their first season back in the top-flight.

Newcastle won the reverse fixture 4-0 at St James’ Park in December, but Leicester boss Ruud van Nistelrooy has been eager to let fans know there is still a lot to play for.

van Nistelrooy warned Newcastle that they will give their all when they come to the King Power Stadium on Monday, but former Arsenal man Merson believes the game is already a foregone conclusion.

Speaking to Sportskeeda about Newcastle’s trip to Leicester, Merson said: “I can’t see anything but a Newcastle win here.

“They secure a brilliant victory over Brentford in midweek. That result has put them in contention for a top four finish. Another win here and they boost their chances even further.

“It’s a dream season already for Newcastle. For them to win that trophy after so long was massively important. Now the icing on the cake would be finishing in the top four and returning to the Champions League. If Newcastle keep playing like this, they will have a strong chance of doing it.

“I’m a big fan of Newcastle’s midfield trio. Joelinton, Sandro Tonali and Bruno Guimaraes – they have everything from guile, strength and pace. They work together so well as a unit and that has made all the difference for Newcastle this season.

Paul Merson’s prediction: Leicester City 0-3 Newcastle United

Merson has become accustomed to mentioning Isak in his predictions amid reports that Arsenal are interested in the striker. But in his latest column, he decided to give the Magpies’ midfield trio their flowers due to how well they have performed in recent weeks.

Newcastle United could move into Champions League spots with Leicester win

While Newcastle fans are focused on their team’s game against Leicester, they are sure to have one eye on other Premier League clashes throughout the weekend.

Chelsea take on Brentford, Newcastle’s most recent opponents on Sunday. Fans will hope for a Brentford win to allow Newcastle to leapfrog them.

Elsewhere, Man City have a local derby on Sunday, as they take on Manchester United at Old Trafford.

Despite the recent defeat to Nottingham Forest, results have picked up for Ruben Amorim’s side, so the game will not be an easy one. Merson himself has predicted a 1-1 draw between the two Manchester sides.

With Newcastle playing Leicester on Monday, they will have all the motivation they need if other results go their way this weekend.

Discover how AI analysis sees Newcastle United’s Premier League clash with Leicester City at the King Power Stadium playing out.

Like it or loathe it, we live a world where AI - or artificial intelligence - is creeping into every corner of society. Long gone are the days of predictive text or autocorrect being your only daily dalliance with an industry that was formerly resigned to the big screen or fiction. Now, it’s in everything, and can do virtually everything, too - including, it seems, predict football results.

So, we asked X’s own AI, Grok, to get its crystal ball out and predict what would happen as Newcastle United take on Leicester City in the Premier League at the King Power Stadium looking to keep driving forward in their quest to land a Champions League return, having missed out on Europe altogether last season. And here’s what it said.

Leicester City v Newcastle United: The context

The Foxes are on an awful run of form, having lost their last eight games in all competitions, scoring just once in that time. And Grok thinks that definitely puts the Magpies as favourites heading down to the East Midlands. It says: “Leicester City are in dire straits, sitting 19th in the Premier League with 17 points after 29 matches. They’ve lost seven consecutive league games, failing to score in their last five, and are 12 points adrift of safety with only eight games left. Their home form is abysmal, with six straight defeats at the King Power Stadium, conceding 15 goals without reply. Ruud van Nistelrooy’s appointment hasn’t turned their fortunes around, and relegation looks increasingly likely. Their goal difference stands at -40 (25 scored, 65 conceded), and they’ve managed just one clean sheet all season.”

On the Magpies, it adds: “Newcastle United, on the other hand, are in a much stronger position, sitting sixth with 48 points after 29 games (14 wins, 5 draws, 10 losses), based on their 2-1 win over Brentford on April 2. They’re two points behind fourth-placed Chelsea, keeping them in the hunt for a Champions League spot. Their recent EFL Cup triumph over Liverpool (2-1 on March 16) has boosted morale, and they’ve won nine of their last 14 league games, including a 4-0 thrashing of Leicester at St. James’ Park in December. However, their away form has been inconsistent, with losses in three of their last five on the road, including a 2-0 defeat to Liverpool in February.”

Leicester City v Newcastle United: Team news

For Leicester, injuries and poor form ‘plague the Foxes’, according to Grok. It says: “Wilfred Ndidi, a key midfielder, is sidelined with a hamstring injury, as is Ricardo Pereira. Harry Winks is doubtful but may be assessed closer to the match. Jamie Vardy, their talisman, has struggled for goals this season, and their attack has been toothless. Probable lineup (4-2-3-1): Hermansen; Justin, Coady, Vestergaard, Kristiansen; Soumare, Choudhury; McAteer, El Khannouss, Ayew; Vardy.”

On the Newcastle United front: “Newcastle have injury concerns but are in better shape. Anthony Gordon may be sidelined with a hip injury, while Sven Botman, Jamaal Lascelles, and Lewis Hall remain out. Alexander Isak and Kieran Trippier are expected to be fit after minor knocks, with Isak in fine form, having scored 20 goals in 26 league matches this season (0.6 xG per game recently). Bruno Guimaraes, who has covered the most distance in the league (310.9 km), will be pivotal in midfield. Probable lineup (4-3-3): Pope; Trippier, Schar, Burn, Livramento; Guimaraes, Tonali, Joelinton; Murphy, Isak, Barnes.”

Leicester City v Newcastle United: Head-to-Head and stats

It says: “Newcastle have dominated recent encounters, winning four of their last five against Leicester, including the 4-0 win in December. Leicester haven’t beaten Newcastle in the league since 2021, and their last home win over the Magpies was in 2020. Matches between these sides at the King Power have often been high-scoring: three of the last five league meetings there have seen over 2.5 goals, with both teams scoring in four of those. Newcastle average 1.62 goals per away game, while Leicester concede 2.24 goals per 90 minutes at home.”

Leicester City v Newcastle United: Prediction

Grok is in no doubt, like many of you out there, that three more points are coming back to Tyneside on Monday night.

“Newcastle are clear favorites, backed by the Opta supercomputer with a 52.2% win probability in similar scenarios,” Grok states. “Leicester’s home record and current form suggest they’ll struggle to contain Newcastle’s attack, particularly Isak, who has a history of scoring against the Foxes (four goals in three games). While Leicester might find the net given their desperation and Newcastle’s recent defensive issues, the Magpies’ superior quality should shine through.”

Leicester City 1-3 Newcastle United

Scorers: Vardy for Leicester; Isak (2) and Guimaraes for Newcastle.
